The law is written very clearly, if you never received a Deposit Protection Certificate, your landlord or agent has broken the law, and you are entitled to your deposit back and compensation of up to 3 times the amount of your deposit. To find out more about this, please see:

Practical tips

Practically, there are some issues with this. Specifically, how do you prove you were not given a Deposit Protection Certificate, or does the landlord or letting agent have to prove they DID give it to you? From our experience helping thousands of tenants, including helping tenants claim the compensation they are legally entitled to, it is best to get proof that the deposit was not correctly protected, as that evidence is often enough to easily win a claim.
